What is a Will?

A Last Will and Testament is a document by which you determine who will inherit your property when you die and what property will be inherited by whom.  You may name a guardian to raise your minor children and appoint an executor to settle your estate.  In your Will you may also make clear your preferences for a funeral or memorial service, or whether you want to be cremated, buried or have your body donated to science.

A Last Will and Testament does not take effect until you die.  It is subject to the Probate Process and it becomes a Public Record as soon as it is recorded. 

A Will does NOT take effect until you die...

If you die without a Will your partner may get nothing -- no matter how long you have been together.

The Last Will and Testament is included in the Deluxe Will Package and Standard Will Package at no extra charge.  A 'Pour-Over' Will is included in the Trust Packages.  It is not available for purchase as an Individual Document

The Probate Process may consume hundreds or thousands of dollars in court costs and attorney fees.

While a Will may seem simpler than a Trust, remember that funding a Trust may be a hassle but it is far less difficult than making your partner endure Probate.  When you sign a Trust YOU do all the work of funding it -- running to financial institutions, closing accounts and reopening new ones, recording deeds, etc.  If you create a Will, your partner will have to do all of these things -- and more -- at a time when he or she should be free to grieve.  Even if you do everything rights, a Will leaves your partner vulnerable in ways a Trust does not.
