Another Favorable Federal Ruling For Virginia Gays
U.S. District Judge Michael F. Urbanaski certified a lawsuit that challenges Virginia’s ban on same-sex marriage as a class action. By granting class action, the plaintiffs will be representing all same-sex couples who want to get married and those who have already been married in other jurisdictions. Attorneys for the plaintiffs estimate there are more than 15,000 same-sex households in Virginia, saying this means that every same-sex couple in the state has “become part of the fight against the state’s discriminatory constitutional and statutory marriage bans.”
The new state attorney general, Mark Herring, has already announced that he will not defend the ban and will join the couples who are challenging it.
Republicans in Virginia’s House of Delegates, who have threatened to impeach Herring, are trying to push through a bill that would permit them to hire their own counsel to defend the marriage ban. But even if approved, the bill would probably be vetoed by the Democratic Governor Terry McAuliffe.
